Clicking on the finder icon in the dock has no effect. To open the finder I have to open the context menu and choose "New Window".
I already stoped the finder process, without success.
How can I fix that?

Create Finder Window with a Shortcut
While this doesn't solve your problem with the dock, using a keyboard shortcut can be much faster and can help in your workflow.
Activate Finder by clicking the desktop background
(If the desktop is cluttered with windows, pinch out to clean it up and then click)Use the New Finder Window shortcut: ⌘ + N
Disable Spaces Auto-Switching
Uncheck the Missions Control preferences checkbox to switch to a space with open windows for an application:

This behaviour happens beacuse the dock just launches an app. Finder is classified as an app, so it will open/show the app window, you will need to open a new window within the app.
You can use the keyboard short cut CMD + N, and if you are not in the app press CMD + Tab to open it first.
You could possibly try using Quicksilver, which makes custom keystrokes, so you could assign O to opening a new finder window

Have you tried simply clicking on the Finder icon in the dock ?
That always works for me.
I would delete my Finder .plist
I would also "zap my PRAM"
